Terms of Trade

Shipping:

We offer the following methods for getting your items from our hands to yours.

Preston Pickup: We’ll wrap it for you if needed or requested and help you load it into your transport

Australian national courier: TNT, Australia Post, etc.  All deliveries come with a tracking number so a delivery date can be isolated however Melbourne Table Co will not be held responsible for any damage occurring in the delivery process.

Furniture Delivery Experts: We have a range of service providers on our books who can move larger items interstate and install them if needed.

Us: We might have a truck by the time you read this or we might hire one if it works out to be cost effective for you. We’ve been known to move furniture in our little station wagon.

No items will leave our workshop until full payment has been made unless prior arrangement has been made.

Customers are responsible for checking that all goods have free and easy access to their intended destination. Additional costs apply for difficult access. An inspection service at an additional fee may be arranged. Purchaser must inspect and note any damages on the delivery docket upon delivery and advise our office within 24 hours.

If merchandise arrives damaged, please notify Melbourne Table Co within 24 hours and retain all packing materials for inspection by the carrier.

Melbourne Table Co accepts no responsibility for damage or injury caused to any unauthorised person handling our goods in delivery or installation.

Storage Fees:

Where products have been prepared for delivery/produced/manufactured or finished in accordance with an agreed delivery schedule and that delivery schedule is delayed so that delivery is deferred beyond the scheduled delivery date, and where Melbourne Table co is required to store the goods at its premises or other premises as required, storage charges will be applied and charged monthly at a rate of 2% of the total value of the goods or $200 per month whichever is greater.

Delivery Issues:

The buyer must advise Melbourne Table Co in writing within 24 hours of receipt:

  1. of the non arrival of any or all of the goods;

  2. if there is damage to the goods;

  3. that the wrong goods have been received;

  4. that the quantity of the goods in incorrect

  5. or the goods do not meet specifications

If you have any special shipping requests, please contact us.

Insurances: Where delivery is quoted ex workshop, then the insurance is the responsibility of the buyer. In other cases, responsibility for insurance shall be agreed in writing between the buyer and seller. Risk in the goods shall pass to the buyer upon delivery.

Submissions:

All remarks, suggestions, ideas, graphics, or other information communicated to Melbourne Table Co through this site will forever be the property of Melbourne Table Co. Melbourne Table Co will not be required to treat any submission as confidential, and will not be liable for any ideas for its business (including without limitation, product, or advertising ideas) and will not incur any liability as a result of any similarities that may appear in future Melbourne Table Co operations. Without limitation, Melbourne Table Co will have exclusive ownership of all present and future existing rights to the submission of every kind and nature everywhere. Except as noted below in this paragraph, Melbourne Table Co will be entitled to use the Submission for any commercial or other purpose whatsoever without compensation to you or any other person sending the submission. Personally identifiable information that may be received at this site is provided voluntarily by a visitor to this site. This information is for internal purposes only and is not sold or otherwise transferred to third parties of Melbourne Table Co or to other entities who are not involved in the operation of this site. Therefore, the above right to use Submissions is subject to this limited use of this information and excludes non-retained information. You acknowledge that you are responsible for whatever material you submit, and you, not Melbourne Table Co have full responsibility for the message, including its legality, reliability, appropriateness, originality, and copyright.

Ordering:

Any of the following actions will be deemed an official sales order and instruction to proceed under the terms of our quotation and terms of trade:

  1. The payment of any amounts due in relation to a Melbourne Table Co quotation, order or invoice, or,

  2. The physical, emailed or digitally transferred receipt of any intent to proceed in relation to a Melbourne Table Co quotation, order or invoice.

Lead Times:

The majority of our products are made to order and the lead times are from 4 to 10 weeks. However, this is an estimate and we can inform you of a more accurate delivery date when quoting.

Orders placed during the summer and over Australian holidays may take a little longer. If orders placed online are back-ordered or expected to take longer than 2 weeks to ship, we will contact you via email with an estimated ship date. Please contact us for more specific information, or if you need to receive a shipment by a certain date.

Lead times are sometimes slowed by delayed payment of an invoice, please insure that you have made payment and sent a remittance so we can move your work along the production pipeline.

Delays in Manufacture:

Melbourne Table Co takes pride in meeting our estimated lead times for delivery of satisfactory product and providing realistic and achievable deadlines for order completion.

In the event that order production is delayed due to circumstances beyond Melbourne Table Co’s control (including but not limited to transit delays, production delays, equipment malfunction), the client shall remain liable for all amounts due under the contract upon the eventual delivery of product, to the extent allowed by applicable law. Clients are asked to provide ample additional time to allow for unforeseen circumstances.

Delays do not constitute a breach of contract and Melbourne Table Co is not liable or responsible for any disruptions or costs incurred.

Timber colour and characteristic variation:

As timber is a natural material there will always be a colour variation, grain and texture variation, knots or marks showing the character of the timber. Variations will not be accepted as a reason to exchange or refund by Melbourne Table Co.

If colour or tone is expressly important please request a sample. However It is not always going to be possible to exactly match a sample due to the nature of timber and our production processes.

Splits and cracks may develop as it responds to the environment and these are not to be considered a fault or flaw and will not compromise the construction of any furniture we supply.

Custom order modifications are possible. These requests must be made in writing immediately and additional costs and lead times may apply if approved.

Cancellations by Purchaser:

Change of mind won't be accepted as a reason for cancellation. If the contract is terminated by the buyer for any reason other than the non-performance of the seller then Melbourne Table Co reserves the right to seek compensation for all stock and time committed specifically to the purpose of fulfilling our obligations under the agreement.

Such compensation would be equal to the cost incurred by the seller for the purchase of the stock in question.

Cancellation of orders by Melbourne Table Co:

Melbourne Table Co reserve the right to cancel any order at any time in which case all funds paid by purchaser will be returned.

Quality Guarantee:

We stand behind the products we make, and strive to ensure all items meet our quality standards. We are happy to repair or replace any item that is found to be defective in its workmanship. This does not include regular wear-and-tear or environmental damage. The choice of repairing or replacing an item is at Melbourne Table Co’s discretion.

Floor stock Sales: All floor stock sales are final. It is the buyer’s responsibility to inspect goods thoroughly before purchase.

Agreement:

This website, quotation or any subsequent revised quotation, when accepted, shall constitute that final agreement between the parties. The offer in any quotation is valid for a period of 30 days from the date noted on the quotation.

Payment Terms:

Unless otherwise agreed in writing, deposit for the goods and/or services is 50% for orders over $500 and 100% for goods and/or services under $500. All deposits must be paid to commence processing your order and balance paid prior to dispatch unless otherwise agreed in writing by Melbourne Table Co.

Melbourne Table Co accepts Visa and MasterCard (via Stripe payment gateway) or electronic funds transfer, We can only accept checks from customers with a valid ID, A five day clearing period and a $10 processing fee.

Payment terms may be revoked or amended at the sole discretion of Melbourne Table Co immediately upon giving written notice to the buyer.

We require a 50% deposit to start the design process, with the balance payable once drawings and details have been agreed.

Melbourne Table Co reserves the right to charge a 1.75% or 2.9% surcharge on all credit card payments dependent on the type of card being used.

Tax:

Unless otherwise stated, all prices quoted exclude GST.

Currency:

All prices quoted by Melbourne Table Co are quoted in Australian Dollars and are exclusive of GST except where stated.

Late Payment:

We expect payment within the terms agreed. Melbourne Table Co will levy a 1.5% compounding interest charge per month on late payment of invoices.

Availability:

Melbourne Table Co will not be liable for any claim arising from failure to deliver or for delay in delivery occasioned by unavailability of materials, strikes, accidents, “acts of God” or any cause or event beyond the reasonable control of the company.

Warranties:

Melbourne Table Co provides a 12 month warranty, unless otherwise specified in the quotation. The warranty covers defects in the materials and workmanship used in the manufacture of the products. The Warranty is that Melbourne Table Co will repair or replace furniture that failed structurally during normal use and proper care and maintenance.

Returns:

Sales are final on custom orders and they cannot be returned. Additionally, used items, items returned without all original packaging, and sale items are not eligible for exchange or return. Returns are not accepted after 30 days from the order’s delivery date.

A restocking fee may apply to any product returned not received in good condition or without original packaging. Shipping costs are non-refundable and all shipping costs are the responsibility of the customer. Exchanges will incur additional shipping charges for delivery of the new item.

To make a return for refund or an exchange, please email us and include your order number, date, and a list of the item(s) you are returning. Please do not return any items until you have emailed us.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

This policy is in addition to and does not affect your statutory rights under the Trade Practices Act.

Ownership:

The product remains the property of the Melbourne Table co until payment for goods or associated services has been received in full. If the buyer fails to make payment (or part thereof), the seller shall be entitled to retake possession of the goods until payment is made or at its option resell the goods but without prejudice, to its other rights and remedies.

Should the purchase of products be made on behalf of a buyer, it is understood that the buyer has read and accepted the terms and conditions of our quotation.

Confidentiality:

Melbourne Table Co agrees to treat in confidence any unpatented inventions, ideas, know-how, concepts, trade secrets, processes, techniques, software, products and all other intellectual property, financial and business products and all other intellectual property, financial and business information and all other commercially valuable information confidential to it, and all copies, notes and records and all related information generated by Melbourne Table Co based on or arising out of any such disclosure of any kind but does not include information which:

  1. at the time of disclosure is already in the public domain;

  2. becomes available to the public by any means other than breach of this agreement by the receiving party;

  3. is received by a party from an independent third party who is lawfully in possession and has the power and authority to disclose the information;

  4. or is required to be disclosed by law.

Security and privacy:

Personal details will not be used or sold for any purpose other than to complete your order and any follow up necessary by Melbourne Table Co.

Melbourne Table Co processes transactions utilizing the latest digital certificate encryption technologies and meets all credit card association standards.

This contract shall be subject to and construed in accordance with the laws of the state of Victoria and parties to the contract will submit to the jurisdiction of the courts and tribunals of that state.

Terms of Use of This Website:

The Melbourne Table Co Website and related Internet properties is an online information service provided by Melbourne Table Co subject to your compliance with the terms and conditions set forth below.

By accessing or using the site, you agree to be bound by the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, you may not access or use the site. Melbourne Table Co may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement on the site. You agree to review the agreement periodically to be aware of such modifications and your continued access or use of the site shall be deemed your conclusive acceptance of the modified agreement.

Melbourne Table Co will not be liable for any damages or injury caused by, including but not limited to, any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure. Melbourne Table Co will not be liable for any damages or injury, including but not limited to, special or consequential damages that result from the use of, or the inability to use, the materials in this site, even if there is negligence or Melbourne Table Co or an authorised representative has been advised of the possibility of such damages, or both. The above limitation or exclusion may not apply to you to the extent that applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages.
